Christoph Burchard nähert sich diesen klassischen Grundlagenproblemen, indem er die Normativität des Vorsatzurteils in aller Deutlichkeit herausstellt. Um es nicht der Beliebigkeit preiszugeben, orientiert er die Irrtumslehre an der Schuld und fundiert sie ferner strafrechtsphilosophisch: Die Irrtumsdogmatik wird in Anlehnung an Max Webers Verantwortungsethik zum einen individualistisch begründet, zum anderen aber auch dem konkret durch eine Tat angegriffenen Mitmenschen ein eigener Stellenwert zugewiesen.
